WeAnswer4U (“Company,” “we,” “us,” or “our”) provides professional call answering, dispatch coordination, and SMS messaging services for towing and roadside assistance companies. By using our services, interacting with our website, or opting into SMS messaging, you agree to these Terms of Service and SMS Terms & Conditions (“Terms”).

1. Definitions

For purposes of these Terms:

  • “Company” – refers to WeAnswer4U, its employees, officers, and affiliates.

  • “Services” – include call answering, dispatch coordination, SMS and email notifications, and any other services provided by the Company.

  • “User,” “Customer,” or “Client” – any person or entity using the Services or website.

  • “SMS Messages” – text messages sent via our SMS platform, including service alerts, account/payment notifications, and promotional messages.

  • “Third-Party Vendors” – companies contracted by WeAnswer4U to provide technology, communication, analytics, payment processing, or hosting services, including RingCentral, Stripe, PayPal, Square, Towbook, and Google Workspace.

  • “Opt-In” – voluntary consent by a User to receive SMS messages from the Company.

  • “Opt-Out” – withdrawal of consent to receive non-essential SMS messages by replying STOP.

2. Acceptance of Terms

By using our Services, signing up for SMS messaging, or accessing the Website, you agree to comply with these Terms. If you do not agree, do not use our Services or provide your phone number for SMS messaging. Continued use constitutes acceptance of these Terms, including any updates posted by the Company.

3. Description of Services

WeAnswer4U provides:

  • Call Answering Services – Professional handling of incoming calls for towing and roadside assistance companies.

  • Dispatch Coordination – Communication between service providers (towing companies, drivers) and clients to coordinate service requests.

  • SMS Messaging – Sending notifications related to service updates, promotional offers, and account/payment alerts.

  • Email Support – Optional email communications for support, inquiries, and account updates.

4. Types of SMS Messages You May Receive

By opting into SMS messaging, Users may receive:

  • Service Updates: Dispatch confirmations, estimated time of arrival, and service completion notifications.

  • Promotional Offers: Periodic marketing messages, discounts, and announcements of new services.

  • Account/Payment Notifications: Invoices, payment confirmations, or subscription-related alerts.

Example Messages:

  • “Your tow has been dispatched. ETA: 15 min.”

  • “WeAnswer4U Special Offer: 10% off dispatch fees this week.”

  • “Payment received for dispatch #12345. Thank you!”

All SMS messages are intended for towing companies and drivers we dispatch to. Messages are not shared with third parties or affiliates.

5. User Responsibilities & Consent

  • Users must provide accurate contact information.

  • Users consent to receive SMS messages for the purposes listed above.

  • Users are responsible for any message or data charges assessed by their carrier.

  • Opting into SMS messaging is voluntary and not a condition for using the Company’s Services.

  • Users are responsible for safeguarding their login credentials and any other security information.

6. Messaging Frequency & Carrier Costs

  • Frequency of messages may vary depending on service requests, promotions, or account activity.

  • Users may receive multiple messages per day when active dispatches occur.

  • Standard message and data rates may apply according to the User’s carrier.

  • Delivery of SMS messages is not guaranteed, and the Company is not responsible for failures caused by carriers or technical issues.

7. Opt-In / Opt-Out Instructions

  • Opt-Out: Users may reply STOP to any SMS to immediately stop receiving promotional messages. Essential service alerts will still be delivered as needed.

  • Help / Support: Users may reply HELP via SMS or contact us via email at customercare@weanswer4u.com for assistance.

  • Users may also contact us through our website: www.weanswer4u.com.

  • Response Time: HELP requests will be addressed within 24 hours whenever possible.

8. Data Collection & Privacy

We collect personal information to provide, maintain, and improve Services. This includes:

  • Contact Information: Names, phone numbers, email addresses, and addresses.

  • Dispatch Data: Service locations, vehicle information, and requests.

  • Call Records: Audio recordings for quality assurance and training.

  • Geolocation Data: Used solely for service dispatch purposes.

9. Third-Party Services & Vendors

WeAnswer4U utilizes third-party services to operate its business, including:

  • RingCentral: Call answering and SMS platform.

  • Stripe, PayPal, Square: Payment processing.

  • Towbook (CRM/Dispatch): Service management.

  • Google Workspace: Email and document hosting.

All vendors are contractually required to maintain industry-standard security and privacy protections.

10. Limitations of Liability

  • The Company is not liable for delays, service interruptions, or errors caused by third-party vendors or carriers.

  • The Company is not liable for indirect, incidental, consequential, punitive, or special damages arising from SMS messaging, call answering, dispatch services, or website usage.

  • Users acknowledge that SMS delivery cannot be guaranteed due to carrier limitations.

  • Force Majeure: The Company is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, technical failures, or internet outages.

  • The Company’s liability is limited to direct damages up to the amount paid by the User for the specific service at issue.

11. Formal Arbitration Clause

  • All disputes arising from or related to these Terms shall be resolved exclusively through binding arbitration, rather than court litigation, to the fullest extent permitted by law.

  • Arbitration shall be conducted under the rules of the American Arbitration Association (AAA), and judgment on the arbitration award may be entered in any court having jurisdiction.

  • Class-Action Waiver: Users agree that they may not participate in class-action arbitration.

  • Fees & Costs: Each party shall bear its own attorney fees and costs unless otherwise required by law.

  • Exceptions: Nothing prevents the Company from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or proprietary information.

12. Modifications to Terms

  • The Company may update these Terms periodically.

  • Updates will be posted on this page with a new Effective Date.

  • Continued use of Services after changes indicates acceptance of the updated Terms.

13. Cookies, Tracking & Analytics
